Common Overtime Violations in Raleigh Workplaces
Wage violations don’t always look obvious. Employers sometimes pressure workers to clock out and keep working, edit timecards after the fact, or label employees as “exempt salaried” when their actual duties don’t qualify for that status. We evaluate the full picture of how hours are assigned, tracked, and paid.
The overtime claims we handle include:
- Off-the-clock work: Pre-shift loading, post-shift closeout tasks, logging into systems before punching in, and travel between job sites during the workday can all be compensable time employers routinely ignore.
- Exempt status misclassification: A job title like “manager” or “coordinator” doesn’t automatically make someone exempt. We assess whether an employee’s actual duties meet the legal standard, not just what their title says.
- Independent contractor misclassification: Workers labeled as contractors but assigned set schedules, required to use company equipment, and supervised daily may legally be employees entitled to overtime.
- Timecard and payroll manipulation: Altering or deleting hours to keep employees under 40 per week is a direct overtime violation, regardless of whether the employee consented.
- Wrong overtime rate: Overtime must be calculated on an employee’s regular rate, which includes certain bonuses and commissions. Employers who use only base pay may undercount what they owe.
We also advise employees who are told to keep their hours under 40 while consistently being assigned 45 to 50 hours of work. That gap between expected and compensated time is often where overtime claims begin.
